Part I of the lecture will review the history of the Medicaid Act, its relationship to tort recoveries, and past litigation over Medicaid liens.  Part I will also review the litigation history of Gallardo v. Marstiller and how the decisional law on Medicaid liens was changing as the case worked its way up to the U.S. Supreme Court.  Part II of the lecture will then cover the U.S. Supreme Court’s decision in Gallardo, as well as Justice Sotomayor’s dissent, and then conclude by discussing strategies for dealing with Medicaid liens in light of the Gallardo decision.
