Brief of American Association for Justice and Public Justice as Amici Curiae in Support of Plaintiffs-Appellees

 

Issues: (1) Whether every buyer must show manifestation of a design defect when they have provided admissible evidence of present economic injuries including overpayment and diminished value; and (2) Whether the district court conducted a sufficiently “rigorous analysis” of the commonality requirement of Rule 23 even though it did not qualitatively evaluate predominant individualized issues as a precondition to class certification.
