Issues: (1) Whether state sovereign immunity applies categorically to third-party subpoenas. The most apposite authorities are the Eleventh Amendment to the U.S. Constitution, Ex parte Ayers, 123 U.S. 443 (1887), and Thomas v. FAG Bearings Corp., 50 F.3d 502 (8th Cir. 1995).

(2) Whether state sovereign immunity applies to Mick’s subpoena under Missouri D.N.R. The most apposite authorities are the Eleventh Amendment to the U.S. Constitution, In re Missouri D.N.R., 105 F.3d 434 (8th Cir. 1997), Sanzone v. Mercy Health, 954 F.3d 1031 (8th Cir. 2020), Animal Legal Def. Fund v. Reynolds, 8 F.4th 781, 785 (8th Cir. 2021), and Thomas v. FAG Bearings Corp., 50 F.3d 502 (8th Cir. 1995).

(3) Whether Missouri D.N.R. should be overruled. The most apposite authorities are the Eleventh Amendment of the U.S. Constitution, Russell v. Jones, 49 F.4th 507 (5th Cir. 2022), and Bonnet v. Harvest (U.S.) Holdings, Inc., 741 F.3d 1155 (10th Cir. 2014).
