Failure to yield to bus
February 14, 2019Anie Gerber was driving through the Riverside Square Mall’s parking lot. She drove to the end of a row of cars and then collided with the front of a bus that was traveling along a through street within the parking lot. Marlene Henry, 61, who was sitting on the bus, was thrown from her seat. She suffered a torn right meniscus, necessitating arthroscopic surgery; and herniated disks at L3-4, 4-5, C5-6, and C6-7, for which she also underwent surgery. She now suffers from pain and has limitations when walking. A home health aide, she has not returned to work since the incident. She incurred $200,000 in unpaid medical expenses.
Henry sued Gerber, alleging she failed to yield to the bus. The plaintiff also sued Community Coach, which operated the bus, alleging the bus driver had been inattentive and failed to avoid the collision.
The parties settled for $975,000. Gerber paid $900,000, and the bus company paid the rest.
