Inadequate security at apartment complex

Justin Acevedo, a 17-year-old landscaper, went to the BCC Apartments to pick up a friend. While Acevedo was sitting in his car, an assailant walked up to him and began shooting. Acevedo was shot once in the head, sustaining catastrophic injuries.

He underwent surgeries, including a hemicraniectomy; spent several weeks in a rehabilitation facility; and required continued therapy after his discharge. He continues to suffer from cognitive deficits, including speech and attention problems. His medical expenses totaled approximately $345,100.

Acevedo sued the owner of the apartment complex and the property manager, alleging failure to implement security measures to deter crime. The plaintiff asserted that although the complex had a history of criminal activity, including prior shootings, the property had no access control, surveillance, or manned security on the premises.

The parties settled for more than $8.6 million.
