Failure to Heed Pedestrian in Crosswalk

August 2018

On his way to an appointment, George Williams, who was in his 70s, entered a crosswalk in downtown Tacoma, Wash. He was struck by a car driven by Sammy Cubean, who was distractedly looking for something in his glovebox at the time of the incident. Williams, who suffered from various health problems, including renal failure and heart disease, suffered a mild closed-head injury and shoulder and rib fractures. His medical expenses were more than $219,300.

Williams sued Cubean, alleging he failed to heed to a pedestrian in a ­crosswalk. The defendant admitted liability but disputed the plaintiff’s damages.

The jury awarded approximately $444,100.
