Important Information on Proposed Amendments to Federal Rule of Evidence 801(d)(1)(A) (Prior Inconsistent Statements)
July 19, 2024The Committee on Rules of Practice and Procedure approved two proposed rule changes for formal comment period in June 2024, including proposed amendments to provide broader admissibility of a testifying witness’s prior inconsistent statements and eliminating language that currently restricts application of the hearsay exemption to prior statements made under oath at a formal proceeding. The formal comment period will close at 11:59 p.m. EST on February 17, 2025.
