Failure to heed stop sign

September 19, 2019

As Amber Briolat entered an intersection, her vehicle collided with the driver’s side of Ann Marie Kuhl-Roy’s vehicle. Briolat, 35, suffered a herniated disk at C5-6 in the crash, necessitating a diskectomy and fusion surgery. She also suffered a broken wrist. An intern at an insurance agency who had worked at a real estate agency earning $35,000 annually, she suffers from chronic pain syndrome and is unable to work.

Briolat sued Kuhl-Roy and her husband, who owned the car, alleging that Kuhl-Roy had negligently failed to heed a stop sign, causing the T-bone collision. Suit did not claim medical expenses.

The jury awarded $8.3 million, including $5 million for Briolat’s future noneconomic damages and $2 million for pain and suffering.

Plaintiff counsel: Christopher D. Filiatraut, Lewis Melfi, and Eric Simpson, all of Southfield, Mich.
