Defective windows in new home

During the construction of their new home, Ronald and Kathleen Leo purchased approximately 50 windows from Jeld-Wen, Inc. The couple noticed water intrusion when they moved into the home, and a subsequent investigation revealed that the windows were the source of the problem. Jeld-Wen replaced some of the windows but did not perform any corrective measures despite the Leos’ warranty claim. As a result, the couple was forced to remove and replace the defective windows.

The Leos sued Jeld-Wen, alleging that its windows contained a redhibitory defect and were defective by design in that the weather stripping in the window frame was too short at the corners, causing water to come through the window. The plaintiffs also alleged that the defendant had breached the 20-year warranty it had issued to them.

The jury awarded $335,000. Posttrial motions are pending.
