Negligent operation of semi-tractor

November 14, 2024

Timothy Sudeith was driving a rental vehicle while traveling for business. While he was driving in the right lane of a highway, a semi-tractor operated by an agent of Ample Trailer or E&J Trailer Sales and Services, Inc., crossed into the right lane from the center lane. Sudeith attempted an evasive maneuver but was unable to avoid a collision. He suffered post-concussive syndrome, resulting in headaches and cognitive difficulties.

He sued E&J Trailer Sales and Service, Inc.; Ample Trailer Leasing & Sales, Inc.; and the driver of the semi-tractor, alleging negligence; vicarious liability; and negligent hiring, retention, entrustment, supervision, and training.

The jury awarded approximately $359,100, including more than $64,600 for medical expenses.

Citation: Sudeith v. E&J Trailer Sales & Serv., Inc., No. 2:20-CV-00063-EBA (E.D. Ky. Apr. 18, 2024).

Plaintiff counsel: Jared C. Niceley, AAJ member Jerome P. Prather, and William R. Garmer, all of Lexington, Ky.
