Negligent operation of work van
June 2020John Bosworth, 48, was driving toward a pump at a gas station when a work van operated by an employee of Mona Electric Group, Inc., accelerated while leaving another gas pump, hitting Bosworth’s vehicle on the driver’s side.
Bosworth, a construction supervisor, suffered a herniated disk at L5-S1 and aggravation of underlying cervical disk disease. He required lumbar fusion surgery and an additional lumbar procedure and was unable to return to work due to ongoing pain and impairment. His past medical expenses were more than $373,800.
Bosworth sued Mona Electric Group, Inc., alleging liability for its employee’s negligent operation of the work van. The plaintiff claimed more than $525,100 in past lost earnings.
The jury awarded approximately $7.48 million. The defense has appealed.
