Inadequate Medical Care at City Jail
May/June 2019Davis v. Correct Care Solutions, LLC, No. CL17-4526 (Va. Cir. Ct. Norfolk Cnty. Nov. 14, 2018).
Reginald Cooper, 56, had various health problems, including a heart condition, high blood pressure, and end-stage renal failure, which required dialysis three times per week. He was sentenced to spend weekends at a city jail after being convicted of a petty crime. After spending time alone in his cell, Cooper experienced stomach pains. He complained that he was ill and requested his medications and the dialysis for which he was scheduled. Nevertheless, Cooper remained in his cell. He was later found unresponsive and transferred to a hospital for emergency dialysis. He died shortly thereafter. Cooper is survived by his two adult children. Cooper’s estate sued Correct Care Solutions L.L.C., its physician, and its physician’s assistant, alleging failure to provide adequate medical care. Suit claimed that, among other things, the defendants failed to ensure that Cooper received his medications and dialysis while in jail. The plaintiff did not claim lost income. The parties settled before trial for $350,000.
Plaintiff counsel: Paul Warren, Jameson Goodell, John Coston, and Gordon Fraser, all of Norfolk, Va.
