Failure to Treat Periodontal Disease

Battle v. Belokonny, No. 2018-170592-NH (Mich. Cir. Ct. Oakland Cnty. July 17, 2019).

Sally Battle received treatment from dentist David Belokonny for approximately 13 years. She then consulted a new dentist, who diagnosed cavities, improperly placed crowns, and periodontal disease. She underwent tooth extractions, bone grafting, and other restorative dental procedures.

She sued Belokonny, alleging dental malpractice for the defendant’s failure to treat extensive periodontal disease, among other things.

The court rendered a $200,000 default judgment.

Comment:
In Schroth v. Roe Dental Prac., No. 17 L 11309 (Ill. Cir. Ct. Cook Cnty. May 30, 2019), a patient, 32, sued a dental practice, alleging liability for unnecessary extractions of all her teeth. The parties settled for $550,000. AAJ members Keith A. Hebeisen and Sarah F. King, both of Chicago, represented the plaintiff.
