Failure To Assist Resident
March/April 2019Mary Grace Spinelli, 85, lived in the independent living section of Wood River Village, a senior housing facility. As she was stepping off a scale in the facility’s medical suite, she attempted to turn around without her walker. She fell to the floor, suffering a fractured femur and nose. Spinelli was hospitalized and underwent orthopedic surgery. During the procedure, she suffered a fatal pulmonary embolism. She is survived by her three adult children.
Spinelli’s children and estate sued Wood River Senior Housing, LLC, alleging its staff failed to provide Spinelli with a walker or otherwise ensure that she was supported while stepping backward and turning around.
The parties settled for a confidential amount.
