Delayed lung cancer diagnosis
June 23, 2020Mark James underwent a CT scan of his abdomen and pelvis at the University of Illinois Medical Center to investigate a possible kidney problem. The test revealed that James had a mass on his right lung, and the interpreting radiologist recommended an additional CT scan and biopsy. The radiologist’s finding and recommendation allegedly were not shared with James.
A year-and-a-half later, James experienced swelling and pain in his right shoulder. A CT scan of his chest led to a diagnosis of metastatic lung cancer. Although James underwent extensive treatment, he died of his disease. James, 63, who had worked as an executive assistant earning $55,000 annually, is survived by his three adult daughters.
They claimed that the hospital was liable for failing to timely share the first CT findings with James and follow up with him about his condition.
The parties settled for $7.5 million before suit was filed.
