Failure to evaluate, treat ER patient

November/December 2024

Doe, 50, presented to a hospital ER, suffering from severe chest pain that had started three hours earlier. Staff allegedly checked Doe’s vital signs, and Doe underwent an EKG and a chest X-ray. He allegedly remained in the waiting room for approximately four hours despite his request to be seen by a doctor. He collapsed in the ER, and resuscitation efforts were unsuccessful. He is survived by his wife and two teenaged children.

The family’s suit against an undisclosed defendant alleged negligent failure to provide proper medical attention to Doe in light of his symptoms. The plaintiff asserted that Doe should have timely received a thorough evaluation and treatment by a physician. The defense disputed the allegations.

The parties settled for $2 million.
