Wrongful chemotherapy treatment

July/August 2024

Doe, 28, was diagnosed as having Stage IIB Hodgkin’s lymphoma. He underwent an echocardiogram, which revealed cardiac valve insufficiency. Roe oncologist prescribed ABVD chemotherapy, and Doe underwent a second echocardiogram about eight days later. This revealed that Doe’s cardiac function had worsened. Roe continued the ABVD chemotherapy. Doe became cancer free but died of ischemic heart disease at age 29.

Suit against Roe alleged that the ABVD regimen was inappropriate for Doe because of his underlying heart disease. The defendant argued that ABVD was an appropriate choice for Doe, whose death resulted from an autoimmune condition.

The parties settled during trial for $3.5 million.
