Failure to discuss risks of orthopedic boot
July 30, 2024John Remali, 73, suffered from diabetes and peripheral vascular disease. When he fractured his ankle, orthopedist David Marsh Jr. treated him. Marsh’s technician told Remali that he needed to wear an orthopedic boot continuously until his follow-up appointment two weeks later. He developed a necrotic wound, which necessitated 10-12 debridements and a below-the-knee leg amputation several months later.
Remali and his wife sued Marsh and his employer, alleging medical negligence and failure to obtain informed consent. The plaintiffs asserted that Marsh should have discussed the elevated risks an orthopedic boot poses for diabetic patients.
The jury awarded over $1.5 million.
