Extraction of permanent tooth
November/December 2023Julia Shannon-Grillo, 13, was referred to oral surgeon James Freeman for removal of four baby teeth in anticipation of orthodontic treatment. Freeman removed four teeth while Shannon-Grillo was under general anesthesia. It was later revealed that Freeman had removed a permanent incisor just to the left of Shannon-Grillo’s front teeth. After an attempt to re-implant the incisor was unsuccessful, she received a dental implant, but this began to fail within several years.
Shannon-Grillo sued Freeman and his practice, alleging negligence.
The jury awarded approximately $229,200. After the trial court denied the defendants’ motion for new trial, the parties settled.
