Minor injured while using electric bicycle
October 8, 2024Doe, a minor, allegedly suffered a cut over his left eyelid while using an electric bicycle.
His father, as his guardian, sued SR Suntour North America, Inc., and others, alleging negligence, strict liability, and breach of express and implied warranties. The plaintiff asserted that the electric bicycle contained defective component parts and warnings and was negligently marketed for use by minors.
The defendant removed the case to federal court.
The parties settled for $5,000.
