Jury awards compensatory and punitive damages for Roundup user’s cancer

February 6, 2024

John McKivison was introduced to Roundup weedkiller at work and continued using the product on his property for 20 years. When he was 45, he was diagnosed as having non-Hodgkin lymphoma. He underwent immunotherapy to treat his condition.

McKivison sued Monsanto Co., alleging negligence, failure to warn of the dangers of Roundup, and product defect. The plaintiff did not claim economic damages.

The jury awarded $2.25 billion, including $2 billion in punitive damages.

Citation: McKivison v. Nouryon Chems. LLC, No. 220100337 (Pa. Ct. Com. Pl. Phila. Cnty. Jan. 26, 2024).

Plaintiff counsel: AAJ member Thomas Kline, Philadelphia; and AAJ member Jason Itkin, Houston.
