Failure to yield right-of-way

Iain McDonald, 42, was driving his motorcycle when Areg Zargaryan, who had been stopped in a driveway, entered the roadway. The two collided, and McDonald was pushed into another vehicle. He suffered neck and groin injuries, necessitating chiropractic care, pain management, physical therapy, and treatment by a urologist. His medical expenses totaled more than $100,400.

McDonald sued Zargaryan, alleging negligence and negligence per se. The plaintiff asserted that the defendant had failed to yield the right-of-way and check for oncoming traffic.

The jury awarded more than $13.9 million.
